When hi profile low life politicians experience bouts of 'personal trouble', such as those recently caused to Smidgen hyrself by the injured citizens who dared to get in the Hi-Way of ole $5 Smidgen(New York Carpetbagger / CA Democrap Dyke Senator Carole Migden, experiencing another episode of career meltdown) during her recent freeway rampage, the trend towards mea-culpas always seems to lead to some sort of rehab, or a reasonable approximation thereof just ask Homosex Chicken Hawk Mark Foley.
However, Smidgens spin staff (having had a lot of experience in these things), appear to have various story lines prepped in advance... the quicker to explain away behavior that in any other individual would provide strong clinical indications of deep Alkaloid Psychosis. The latest spin / switch regarding causes of her high speed odyssey ending in highway carnage in a state vehicle (a hybrid no less, oh the Carbon Offsets Lost!), changing the focus from a Cell Phone as the Culprit, to Doctors, and as yet unspecified chemicals which may only mimic Alkaloid Psychosis, is a gem.
In searching for the right words of summation and consolation to acknowledge the current sad situation of a Womyn, who once upon a time, after ascending to the throne of the State Senate Appropriations Committee, boasted to the World: "Anybody who wants $5 is going to have to come to this Dyke and Beg for it" (sfgate.com 12/15/04 M&R report); I have turned as a pigeon homing on a fitting monument to quoting the Eulogy for Aunt Edna so movingly delivered in the rain by nephew Clark W. Griswold (chevy chase in national lampoon) before leaving her rug wrapped corpse sitting in a deck chair in her sons back yard: Yea, though the Hindu speak of Karma.
Speaking of Karma, in all its media manifestations, there certainly seems to have been a change of the reading of the runes at the CC Times, at least as regards reporting on $5 Smidgen possibly due to the new MediaNews masters, or maybe Vorderbrueggen was off this week. Regardless, the past practice of our Watchdogs has been to turn a blind eye to the scams of Smidgen, such as the Ghost Voting Non-Scandal; where she stole the vote of local assemblyman Guy Houston - Or, as Ole $5 Smidgen - Chair of the powerful Senate Appropriations Committee said: There's no story there.
It once took the CC Times considerable prodding by a so called Conspiracy Theorist to even publish the Ghost Vote story (long after the Frisco Crock-a-bull did ( Migden crosses the line. SFGate (9/7/05)), despite fact that it was the local assembly district that Smidgen dumped on. A looming battle between two of San Francisco's best-known gay and lesbian officeholders already is splitting the Bay Area's Democratic faithful, Assemblyman Mark Leno, 55, is taking on state Sen. Carole Migden in her bid for re-election, and plenty of Democrats are unhappy at the prospect. Her friends and supporters already are taking aim at Leno.
Just days after the assemblyman announced he was challenging Migden, Michael Colbruno, a former aide to Migden, posted an item on his personal blog slamming Leno as the "kiddie porn king'' for his Democrat-backed bill last year that would have allowed possession of 24 pieces of child pornography to be treated as a misdemeanor.
A number of members of the (radical homosex) community screamed foul, and Migden disavowed the posting and persuaded Colbruno to remove it from his Web site. But Leno's biggest plus could be Migden herself, whose often-abrasive, take-no-prisoners political style has left plenty of bruised feelings behind her over the years, even among fellow Democrats.

In high political circles, the challenge of an incumbent in a party primary is considered the ultimate taboo...
Assemblyman Mark Leno, a San Francisco Democrat challenging state Sen. Carole Migden, knows all about the instinct of leadership to protect its own.
"I took a great hit this past year in terms of the number of bills I got through the Senate and signed by the governor," Leno said. He had 12 signed in 2006, three in 2007. "I would say it's a stretch of the imagination to think my candidacy had nothing to do with that."
Migden may get yet another formidable Democratic challenger: Joe Nation, a wonkish former state Assemblyman from Marin County who felt the power of incumbency when he challenged U.S. Rep. Lynn Woolsey in 2006. Nation raised almost $700,000 - impressive for a challenger - but Woolsey raised twice as much, including $700,000 from Washington political action committees, and won with 66 percent.
"That's always the challenge - people always tend to bet on incumbents," said Nation, who has commissioned a poll on his Senate prospects.
Nation's entry would thoroughly upend an already intense race between Leno and Migden, with San Francisco police commissioner Joe Alioto Veronese as a wild card. About 55 percent of the voters live in Marin and Sonoma counties, which is Nation's base.

Burton Holed Again
While the CC Times / MediaNews refuses to explain the nature of their deal with local politico Clint Reilly - apparently worked out to placate his complaints about the insider relationship between the SIngleton Syndicate (MediaNews / CCTimes & many more) and the Hearst Syndicate (Frisco Crock-a-bull...) and potential anti trust and related conflict of interest issues between these bought and paid for Old Media 'watchdogs', Reilly's latest freely published revelations in print are very interesting, particularly given his insider background.
His most recent piece was printed under the heading of a "Public Service Message" in the Times, but it is sadly not available on the Times website, which would have made this post much easier, which may well be why it is not on the net. However, a well connected insider like Reilly's comments about a Weimar Kalifornia Legislature truly not fit to pass gas, and the Hacks and Flacks that make it so - like Power Broker John Burton, are worthy of reprint...
If only because of Burton's close relationship to developing the Radical Gender Feminist / Homosex Power Structure now existing along the Sodom by the Sea / Sacratomato axis of evil... Sometimes also known as the I-80 $5 Smidgen (state senator Carole Migden) Freeway Rampage Route.
Additionally, his connection of the New York Carpet Boxer - 'Babs Bag It' (now Senator Barbara Boxer - Democrap SF) to her mentor and sponsor Burton, provides insights in to the Coke Driven Nightmare of SF Politics that propelled her own rise to power, as well as that of others like ole $5 Smidgen (who generally looks like Napoleon Dynamite in Drag having a Bad Hair Day after a week long Coke Binge)... Not that there is any proof that the drugs admittedly used by $5 Smidgen during said Freeway Rampage were illegal, as the CHP declined to test the Powerful State Senator after the Wreck that ended the Rampage.
Besides, only a cynic, or someone with no future in Government service, would question whether this decision to give $5 Smidgen a free pass on testing after a Rampage ending Wreck was influenced by considerations of hyr tremendous Power over State Tax Spending, when upon becoming head of the Senate Appropriations Committee Smidgen boasted: "Anybody who wants $5 is going to have to come to this DYKE and BEG for it!".
Anywayyyyy... Reilly starts out by saying:
"One of the most egregious examples of the Broken System in Sacramento is the dual role of Legislator / Lobbyist played by one leader - former President Pro Tem John L. Burton (Democrap-SF) when he was Assemblyman, State Senator and President Pro Tem of the Senate. I first met Burton when I was Managing Barbara Boxer's campaign for congress in 1982. Burton had announced his retirement from Congress because he suffered from a Major Drug Problem. His chosen successor was Marin Supervisor Barbara Boxer, who I knew and helped over the years."
"The problem, however, was that Burton was still active in Boxer's campaign. Several times an incoherent Burton insisted I attend 7am meetings in his office on campaign strategy... Burton never showed up. Usually he would materialize unannounced in my office when I was not there and wander the halls intimidating my staff with his irrational behavior. Frantic phone calls and meetings were filled with ranting and incomprehensible speeches. He was clearly still using drugs during the campaign when he was a U.S. Congressman and presented a real danger to the success of Boxer's campaign."
Reilly then goes on to describe a path of parasitic leeching off the Taxpayers by Burton and his cronies / family, including being given a nicely paid patronage spot at the Tax Trough by his good buddy 'Slick Willie the Lesser' (Brown), as well as enough financial conflicts of interest while in the assembly & state senate to make Der Arnold look like a reformer. For example:
"State records also confirm that while an elected State Senator, John L. Burton lobbied on behalf of corporations for transit advertising contracts on muni buses, artificial turf at Golden Gate Park... (and a host of others)... A lucrative working relationship with a Bay Area Mega-Lobbyist enabled Burton to conceal the identity of many special interest clients. When he left office Burton squirreled away a secret two million dollars slush fund from California's most powerful special interests, which he has used in political campaigns to smear political opponents... And state taxpayers subsidize Burton's Daughter, Kimiko (former SF Public defender) who has a lucrative appointment as California's Inheritance Tax Appraiser."
In closing - Reilly asks what must be a truly rhetorical question, which anyone with a knowledge of the insider scams of the Democrap Power Machine already knows the answer to, when he poses: "How can a State Senate Leader be an independent voice for public interests when he is literally on the payroll of special interests while serving in elected office??
The Answer of course is - Easy. Just Join the Democrap Party and adhere to their Mandatory Radical Leftist / Gender Feminist / Homosex 'Pander or Perish' agenda - and you can steal the 'Vanilla' (clueless voters / taxpayers) blind with the approval of the Party, so long as you don't break ranks on important issues - like Pimping School Children to the Sick Hatreds and Viler Perversions of this 'Cannibal Soup' coven.
Really now Mr. Reilly - It Should have been as obvious as the addled look on $5 Smidgens face, as shye plowed in to the car stopped in front of her at the exit she took at the end of hyr Senatorially Privileged Freeway Rampage.

Lawmakers returned to the capitol last week and they are already engaging in mischief. Following on the heels of a very successful 2007 session for the homosexual lobby, Senator Carole Migden has re-introduced legislation that will expand domestic partnership to all adults, not just homosexuals and the elderly. SB 1066 is almost identical to last session's SB 11 (also by Migden) that failed to get out of the Assembly.
Emboldened by Governor Schwarzenegger's proclivity to side with the homosexual lobby, Senator Migden will push this very detrimental measure through the legislature.
Under current law, homosexual couples and heterosexual couples over the age of 62 with a common residence may establish a domestic partnership by filing with the Secretary of State. SB 1066 would delete the same-sex and age requirements for domestic partnership. To grant domestic partnership rights to everyone is degrading to the invaluable institution of traditional marriage.
With domestic partnership, couples will receive all the benefits of marriage without actually be married. This "faux marriage" does not encourage couples to get married and raise a healthy family. Senator Migden has publicly stated that her bill is a response to the "changing family".
While it may not have the controversial label "gay marriage" that evokes such strong opposition, SB 1066 is a direct assault on the institution of marriage. If traditional marriage can be rendered meaningless by the law, then homosexual marriage will be the next step.

Matier & Ross 1/27 SFGate: Burton @%*^$!: That sexual harassment lawsuit that the executive director of John Burton's foster-child charity filed against him came as no surprise to friends and ex-colleagues of the onetime state Senate president. For years, Burton has been well-known his four-letter flames at members of both sexes.
The demand by Kathleen Driscoll for $10 million from Burton, however, was a bit of a jaw dropper.
"It's meant to be punitive," said Driscoll's lawyer Kelly Armstrong, adding that Driscoll also wants to use the money to set up her own nonprofit for abused women and victims of sexual harassment...
On Thursday, the day after the suit was filed, state Sen. Carole Migden, D-San Francisco, called the 75-year-old Burton to make sure he attended her fundraiser that night as the event's "special guest."
Burton himself is keeping mum.
"My lawyer told me, 'For once in your life, don't say anything,' " Burton said when we called.
"And for once in my life, I'm going to listen."

SACRAMENTO -- If Proposition 93 passes Tuesday...In what has been one of the more lively Bay Area Democratic primaries, Sen. Carole Migden, D-San Francisco, and term-limited Assemblyman Mark Leno, D-San Francisco, boasted huge war chests in their campaign finance reports.
Leno's campaign accused Migden of fudging her numbers and claimed to have the most money to spend in the primary.
"The only number that matters in these reports," said Tom Higgins, Leno's campaign manager, "is the actual amount of cash each candidate has available to spend in the primary election."
A message left with Migden's campaign manager was not returned.
Of all Bay Area lawmakers, Perata has the biggest campaign treasury with $2.3 million. He raised nearly $1.4 million and spent $1.3 million among five different accounts. He also rais

"Harvey Milk was a true American hero," Assemblyman Leno explained at a recent press conference. "He gave hope to a generation of gay and lesbian individuals whose basic humanity and freedom had been denied and dishonored." Milk was killed in 1978 by a fellow San Francisco county supervisor. Considered a martyr for the homosexual movement, Milk is now a hero for the homosexual community. The Executive Director of Equality California, Geoff Kors, described their support for the bill by stating that, "Harvey Milk knowingly put his safety at risk and ultimately gave his life because he believed that living as an openly gay man would help achieve true equality for lesbian, gay, bisexual and transgender Americans."
The new bill (still awaiting a number) will declare Milk's birthday, May 22nd, 'Harvey Milk Day' for all of California. This is yet another example of the campaign to normalize homosexual behavior not just in schools, but in our culture.

Nation joins field challenging Migden

Former San Rafael Assemblyman Joe Nation announced Saturday that he will jump into the crowded race for the seat held by state Sen. Carole Migden, D-San Francisco.
Nation, 51, said he would make climate change and health care his top priorities. He works as an adviser on climate change for Environ International, an environmental consulting firm, and teaches at Stanford University.
The race for the Third District seat, which includes Marin County and parts of San Francisco and Sonoma counties, is one of the fiercest political fights in the Bay Area. Migden is being challenged by Assemblyman Mark Leno, D-San Francisco, and Joe Alioto Veronese of the Police Commission.

Those who follow the local newscasts have had a chance to see both Senate Power Dyke Carole '$5 Smidgen' Migden and her opponent - Coprophile Caucus Leader and Challenger Mark "Kiddie Porn King" Leno - on the bube tube lately, and a contrast in styles it was indeed.
Smidgen, a New York Carpetbagger remnant from John Burton's Coke fueled Congressional Empire now representing the Democrap Machine in Sodom by the Sea, when not engaged in chemical fueled freeway rampages in state cars - sported her usual death pallor bleach blonde medusa look for the cameras, kind of like napoleon dynamite having a bad hair day after a week long coke binge, only different.
By Contrast - Leno (another New York Carpetbagger) certainly looks pale and thin to the point of emaciation, but then the Coprophile 'lifestyle' has not proven conducive to good health or avoidance of the ravages of the various diseases that regularly pass through the Homo-Anal population in Frisco.

Proving the fact that no one is safe from the politically correct indoctrination being forced on citizens by arrogant lawmakers, Senator Carole Migden has introduced a bill that would mandate "sensitivity training" for caretakers in senior care centers. Specifically, Senator Migden wants training to "prepare them for the sensitivities of serving lesbian, gay, bisexual, and transgender seniors." This bill reveals just how far the homosexual agenda is willing to go in controlling citizens. Senior care takers are typically gentle, loving, devoted individuals dedicated to meeting the basic needs of their patients. A homosexual patient is no different from a heterosexual patient when it comes to food, medicine and general care. To require "sensitivity training" is to establish a special class of patients just because of their past sexual choices. It is embarrassing that a lawmaker would demand sensitivity training for some of the most generous professionals in the healthcare industry.

A new booklet called Just the Facts about Sexual Orientation and Youth is being distributed to the superintendents of all 16,000 school districts in the United States.
This misguided booklet was instigated by the homosexual activist group, the Gay, Lesbian and Straight Education Network (GLSEN). GLSEN saw the "need" for this booklet when staff at GLSEN attended a Focus on the Family conference in 1998 where "reparative therapy" for homosexuals was being encouraged. Reparative therapy is counseling for homosexuals who want to leave that lifestyle.
The fact that GLSEN is the one who pushed for the creation of this booklet should tell you that Just the Facts is not an unbiased publication. This booklet was created with an agenda in mind. Hopefully our nation's superintendents will be discerning enough to see through this scheme.
The Just the Facts booklet derides churches and religious organizations that offer hope and counseling for homosexuals who desire to change their same- sex attraction. The booklet contends that homosexuality cannot be "cured" and that school districts should have zero tolerance for advocates of reparative therapy.
It warns school districts that they should welcome only one view on homosexuality-the view that this lifestyle is perfectly normal and should be embraced.
The irony is that people successfully leave the homosexual lifestyle every day. This particular fact is curiously missing from the Just the Facts booklet. That people regularly abandon the homosexual lifestyle is proof that reparative therapy can be successful and should not be disregarded.
Just the Facts is not about school districts being more "tolerant." It's about school districts being pro- homosexual. It's about forcing one viewpoint on all teachers, administrators, and students.
Just the Facts is not about the free flow of ideas, which is what education should be about. It is about squelching the traditional religious perspective, which has existed for thousands of years, and denying free speech to countless individuals.
We must be reminded that, here in California, the homosexual movement has already pushed forward with an anti-religious, pro-homosexual agenda using SB 777 as their main tool.
SB 777, which was passed by the state legislature in 2007, forces public schools to treat homosexuality as an option that is equivalent to marriage between a man and a woman.

Calif. campaign watchdog commission fines state lawmaker $350,000 By STEVE LAWRENCE, Associated Press Writer SACRAMENTO, (AP) -- The state's political ethics commission has approved a record $350,000 fine for a state senator who admitted repeatedly violating California's campaign finance laws.
The Fair Political Practices Commission voted 4-1 Thursday to impose the penalty on Sen. Carole Migden. FPPC officials said it was the largest fine ever levied by the commission in its 33-year history. Migden, a San Francisco Democrat, signed a stipulation on Monday admitting 89 violations of the state's Political Reform Act from 2003 to 2007, including using more than $16,000 in campaign donations for personal purposes.
Other violations included failing to report tens of thousands of dollars in contributions on time, understating more than $236,000 in campaign receipts and nearly the same amount in expenditures, failing to keep proper records and failing to spell out credit card charges.
Ross Johnson, a former state senator who chairs the commission, said Migden's violations showed her "complete disdain" for California's campaign finance laws.
James Harrison, an attorney representing Migden, said Tuesday that the violations stemmed from the senator's focus on her legislative duties and her battle with leukemia.
Harrison said Migden conducted her own review of her campaign finances after she was fined $16,000 by the commission in 2006 for failing to file timely campaign reports. She then voluntarily reported additional violations to the FPPC, Harrison said.te
Commissioner Robert Leidigh cast the only vote against the fine. He objected to an arrangement that gives Migden up to a year to pay $250,000 of the penalty, saying the commission should order her to pay all the money immediately.
Migden already has paid $100,000 out of her own money rather than tapping campaign funds.
A commission spokesman, Roman Porter, said staff members could not recall another case in which anyone had paid that high a fine out of their own pocket.
The FPPC's action doesn't end Migden's troubles with the FPPC. Even more striking than the magnitude of the case against Migden is the evasiveness of her answers about the many thousands of dollars of credit card purchases in dispute. After all, the law is decidedly lenient about interpreting campaign expenses, as the jet-ski travel illustrates. Pressed for an example of a purchase that fell into what her attorney called "a gray area," Migden said, "I don't know."]
Now think about her answer. If you're Carole Migden, and you're locked in an extremely tough re-election campaign against two experienced and appealing politicians, Mark Leno and Joe Nation - and you are paying the first $100,000 installment of the fine out of your own pocket - don't you think you would know exactly what the expenditures in question were? A potentially greater problem for Migden is the FPPC's attempt to prevent her from using $647,000 in surplus funds from her past campaigns for state Assembly and the Board of Equalization. The latest batch of campaign finance reports has a little something for everyone to crow about in the hard-fought - and expensive - Democratic clash to oust San Francisco's Carole Migden from her state Senate seat...
Leno, who has been raising money for his run against Migden for more than a year, collected more than $142,000 in the first part of this year - but he spent $244,000 in the same period on a blitz of television ads and campaign mail, leaving him with $180,000 in the bank and $87,000 in bills..
Leno, who is termed out of his Assembly seat, has received contributions from several legislative colleagues, including $3,600 from Assembly Speaker Fabian Núñez, D-Los Angeles, and $2,000 from incoming Speaker Karen Bass, D-Los Angeles. He also received $1,000 from Democratic state Controller John Chiang and the $3,600 maximum from Michael Tilson Thomas, music director of the San Francisco Symphony.
Incumbency has its advantages for Migden. Facing a $350,000 fine from the state Fair Political Practices Commission for campaign reporting violations, an ongoing legal battle with the commission over the status of $647,000 in campaign funds state officials have barred her from using, and constant attacks from Leno and Nation, Migden still managed to take in $125,000, giving her a $377,000 campaign bank account, with $19,000 in unpaid bills.
Much of Migden's money has come from labor unions, including the California Nurses Association and the International Brotherhood of Electrical Workers. She also collected $3,000 from former state Sen. John Burton and $3,600 from Emily's List, which supports pro-choice female candidates.
Migden's fundraising could get a major boost this weekend when she seeks the official endorsement of the state Democratic Party at its convention in San Jose. If she can collect the support of more than half the delegates from her Senate district Saturday, it opens the door for official backing from the state party.
That would make it easier to gather what could be hundreds of thousands of dollars in money promised by her colleagues in the state Senate. The party endorsement could give them the official vehicle they need to back Migden in the June primary.
"Carole's been working on this endorsement for four or five months, and I don't think her opponents will be able to organize an effort to block it," Ross said. Leno and Nation are calling delegates in an effort to keep Migden from getting the majority she needs for the endorsement. If she receives the district's nod, Leno's supporters have vowed to collect enough signatures from delegates to force an endorsement vote of all convention delegates on Sunday.

California's political watchdog agency filed a $9 million lawsuit Tuesday against state Sen. Carole Migden, accusing the San Francisco Democrat of consistent and deliberate violations of the state's campaign finance laws.
"For years, Senator Migden has been deceiving the voters of California by filing inaccurate campaign statements, fabricating the elimination of committees and concealing campaign funds," Ross Johnson, chairman of the Fair Political Practices Commission, said in a statement.
"The sophisticated and pervasive pattern of deception by her various controlled committees has been ongoing for more than five years."...
The commission's lawsuit comes a little more than a week after Migden admitted making a separate series of campaign violations and agreed to pay a record $350,000 fine. The action was filed in federal court in Sacramento in response to a lawsuit Migden filed earlier this month over whether she could tap the $647,000 left over from her campaigns when she was in the state Assembly.
She is facing a tough primary challenge for re-election to the Senate from two fellow Democrats — Assemblyman Mark Leno of San Francisco and former Assemblyman Joe Nation of San Rafael. She wanted to use the money from her Assembly account for the primary race in advance of the June 3 election.

Casting a Wider Net for Online Predators (FRC)
Congress has shown its willingness to fritter away taxpayer dollars on everything from lobster biscuits to fruit fly research, but when it comes to protecting children, Capitol Hill's big spenders are nowhere to be found.
According to FBI Director Robert Mueller, that stinginess is about to cost us. At a House Judiciary hearing yesterday, the nation's top investigator said the agency can't keep up with the amount of child pornography that's mushrooming across cyberspace. "We're losing," he said. "It's growing," Mueller told the committee. "The Internet has provided the vehicle for expansion that otherwise would not be there... We have almost 270 agents working nationwide, but I'm not going to tell you that it is sufficient to address this." The task forces around the country "need to be funded," he said. "It's not just one agency, it's a number of federal agencies, state and local law enforcement, all to be integrated in addressing what is [a serious] problem."
Just how serious is it? Earlier this month, in the little town of Herndon, Virginia--population 23,000--police seized over 1,000 computers that contained files of child pornography. And that's just a tiny fraction of the known violators in one state! Unfortunately, far too many Americans--including our own leaders--fail to understand the dangers of child pornography or the prevalence of it. Not too long ago, psychologists at the Federal Bureau of Prisons studied 155 prisoners who had been convicted of possessing or distributing child pornography. At sentencing, only 26% were known to have been active child molesters, but in confidential surveys, a shocking 85% admitted to abusing at least one child.
Child pornography is not a victimless crime. As former Attorney General Alberto Gonzales has said, "Most images...of child pornography depict actual sexual abuse of real children. Each image literally documents a crime scene." Technology is giving these pedophiles a place to hide and a community where they can prey on unsuspecting children. Until Congress and the states provide the funding that law enforcement needs to wage this war, children will continue to be on the losing side. Last year, the bipartisan coalition of Reps. Steve Chabot (R-Ohio) and Nicholas Lampson (D-Texas) and Sens. John McCain (R-Ariz.) and Chuck Schumer (D-N.Y.) introduced bills that would have combated this online lawlessness and forced electronic service providers to report child pornography.
To date, the liberal leadership has done nothing to advance this Securing Adolescents from Exploitation (SAFE) Act. The Internet is on the verge of a moral meltdown, and Capitol Hill can't find its voice.

Migden hits stump in tough re-election bid - John Wildermuth, Chronicle Staff Writer May 11, 2008 ...In a district where Democrats outnumber Republicans 55 percent to 16 percent, the winner of the Democratic primary will probably be a shoo-in in November's general election, which means Migden has three weeks left to make her case for re-election... The 59-year-old Migden, who has been in political office since she was elected to the San Francisco Board of Supervisors in 1990, has plenty of fences to mend ...
In August, she pleaded no contest to misdemeanor reckless driving after a wild, 30-mile ride down Interstate 80, weaving through traffic, bouncing off the center divider and finally rear-ending a car. In March, she agreed to pay a record $350,000 fine to the state for campaign finance violations that included personal use of campaign funds.
Leno, who is termed out of his Assembly seat after six years in office, says he jumped into the state Senate race last year to provide voters with a choice, but there's also a bit of payback involved.
When Migden left the Assembly in 2002 to run successfully for the state Board of Equalization, she backed former San Francisco Supervisor Harry Britt over Leno in the race to succeed her. Leno beat Britt.
Leno's decision to challenge Migden is another face-off between leaders of San Francisco's lesbian, gay, bisexual and transgender community, and has split not only progressives but Democrats across the state.
Leno is backed by Newsom, San Francisco District Attorney Kamala Harris, Assessor Phil Ting, three San Francisco supervisors, the Alice B. Toklas LGBT Democratic Club and the state Assembly Democratic leadership. Migden gets support from U.S. Sens. Barbara Boxer and Dianne Feinstein, North Bay Rep. Lynn Woolsey, San Francisco City Attorney Dennis Herrera, four San Francisco supervisors, four Marin County supervisors, the Harvey Milk LGBT Democratic Club and every Democrat in the state Senate.
While Nation is hoping to roll up big numbers in Marin and Sonoma counties, he didn't make any friends among the area's progressive voters when he challenged Woolsey in the 2006 Democratic primary. He tried to paint Woolsey, one of the most liberal members of Congress, as too ineffective to be re-elected - and lost by a 2-to-1 ratio.
There's little love lost between Migden and either of her two opponents... she said. "I'm a lefty, lesbian, progressive San Franciscan who's achieved a lot."

United States Supreme Court Allows Federal Law Against Child Pornography To Stand
(LC) Washington, DC – Today, the U.S. Supreme Court issued a 7-2 ruling upholding a federal law that makes it illegal to knowingly offer to provide or request to obtain child pornography. In United States v. Williams, the Court upheld the law known as the "Prosecutorial Remedies and Other Tools to End Exploitation of Children Today Act of 2003."
In an opinion by Justice Antonin Scalia, the Court held that the law does not violate the First Amendment, noting that offers to engage in illegal transactions are not protected by the First Amendment. Justices Souter and Ginsburg dissented, arguing that porn peddlers who trick purchasers with fake child porn should not be prosecuted.
The Court has already ruled in an earlier case that laws may prohibit obscene material depicting actual or computer-generated images of children engaged in sexually explicit conduct, and any other material depicting actual children engaged in sexually explicit conduct.
In 2002, the Court struck down an earlier law passed by Congress that would also prohibit materials that were not really child pornography, such as photos of youthful adults. As a result, Congress reacted by passing the current law that the Court upheld today, which provides for a mandatory 5-year sentence for promoting or attempting to obtain child pornography.
Mathew D. Enedina Hidalgo, the director of personnel for the state Senate, overheard Migden screaming, according to a witness to the event. The source said she entered the office while the senator was not present on Thursday, informing the staff of their rights. Soon after, Hidalgo returned to Migden's office with Tony Beard Jr., the chief sergeant-at-arms of the state Senate. They told the staff to pack up their belongings...

Leno sets one debate, Ammiano bows out

The (not so) Great Debate: Among the questions city voters will decide Nov. 4 is who should represent the city in the state Assembly and Senate.
But while the Democratic candidates - Mark Leno for the Senate and Tom Ammiano for the Assembly - are the odds-on favorites in this overwhelmingly liberal city, voters won't get much of a chance to evaluate the alternatives.
Leno has just one debate scheduled with his opponent, Republican Sashi McEntee. That debate, hosted by the League of Women Voters, will take place at the San Francisco Public Library at 7 p.m. on Oct. 7....
Ammiano, however, has rejected a request from his Republican opponent, Harmeet Dhillon, for a debate. Dhillon wrote to the supervisor asking for a debate sometime in early October. Ammiano responded in a letter, saying, "My schedule does not permit me to participate in a debate."
But Dhillon campaign manager Ed Sheppard noted that Ammiano, a former comic, performed at Comedy Day at Golden Gate Park on Sunday. "If he is really that busy, how does he have time for that event?" Sheppard said.
(Ammiano's set, in case you're wondering, included a joke about how U.S. Sen. Dianne Feinstein's hair belongs in the movie "Planet of the Apes" and several risqué punch lines that we can't print in a family newspaper.)

True blue: The only thing missing from this weekend's Fleet Week celebration was the annual move by members of the Board of Supervisors to ban the Blue Angels.
"What can I say: People love 'em, people hate 'em, people love to hate 'em, but this year it just wasn't a priority," said Supervisor Tom Ammiano.
Plus, as Ammiano noted, it's a presidential election year, and everyone is working to help elect Barack Obama.
"So maybe this year we won't give Fox News another 'San Francisco values' story," Ammiano said. "But trust me," he added. "It will be back."
While the supes were silent, Mayor Gavin Newsom did manage to get in a political dig.

We can understand an outburst of boos, whistles and foot stomps when a political foe steps up before a crowd of opponents, especially in hyper-caffeinated San Francisco.
But Assemblyman Tom Ammiano crossed the line when he shouted "You lie!" at Gov. Arnold Schwarzenegger during a Democratic fundraiser in San Francisco on Wednesday night. Ammiano reportedly went even further on the crass-o-meter when he suggested that the governor could kiss his posterior.
Ammiano is famed for his rapid-fire comebacks and saucy jokes. A phone message from him usually includes a gibe or two. The guy can't fully separate his past as a part-time nightclub comedian from his present gig as a San Francisco assemblyman - and usually that's a good thing.
The governor was invited for a brief visit to a Democratic Party event by former Mayor Willie Brown.
Ammiano should be ashamed, not only for his rudeness, but for his unoriginality. "You lie!" were the words Rep. Joe Wilson yelled at President Obama during his health care speech to Congress, prompting liberals from Manhattan to Pacific Heights to make snooty remarks about Republicans and South Carolinians.
Thank Tom Ammiano for proving that bad manners have no ideological or geographic boundaries.

Homosexual legislators get cushy 'jobs' from Schwarzenegger, Democrats (CCF)
Three aggressive homosexual activists in California have more time and money to attack family values, parental rights, and religious freedom now that they've been appointed to the easiest and highest-paying "jobs" in state government.
John Laird, Sheila Kuehl, and Carole Migden are termed-out homosexual state legislators. Over the last several years they have authored the bulk of intolerant homosexual-bisexual-transsexual laws undermining marriage, trampling religious freedom, and sexually indoctrinating children.
So, as a "good-bye" present, the Democrats that rule the California Senate and California Assembly, along with California's liberal Republican Governor, have appointed these three homosexual activists to very cushy, high-paid positions on the California Integrated Waste Management Board, which meets four days a month and pays $132,178 a year.
For years its been known that this waste board -- which is supposed to supervise landfills, trash disposal, and recycling -- is duplicative of other government services and should thus be eliminated. This latest action by the Democrat politicians and Governor Schwarzenegger demonstrates their addiction to wasting millions of taxpayer dollars and pushing the intolerant homosexual agenda against everyone else.

It's official: Migden named to waste board (SacBee)
Gov. Arnold Schwarzenegger officially named San Francisco Democrat Carole Migden to a high-paying seat on the state's waste board on Friday. The job pays $132,178 per year.
The appointment was announced Friday afternoon by the Schwarzenegger administration along with a slew of other, largely unpaid board posts, such as members of the board of directors of the Grand National Rodeo, Horse and Stock Show. Capitol Alert reported Migden was likely to receive the appointment last week.
Migden, who lost her Senate reelection primary to then-Assemblyman Mark Leno in June, is the third ex-lawmaker to land of the lucrative Integrated Waste Management Board in the last two weeks. The first was ex-Assemblyman John Laird. Then came former Sen. Sheila Kuehl. All three are Democrats. All three also happened to be members of the LGBT caucus.
Migden is a controversial pick after the series of public missteps that helped lead to her electoral deficit in June.
A couple years back, she pressed the vote button of an Assembly Republican for her own legislation. Earlier this year, she paid a state record $350,000 fine for campaign finance violations.
She pleaded no contest to misdemeanor reckless driving after a 30-mile drive in her state-owned SUV ended in a collision.
And in August, Senate officials sent her staff members home after she was heard berating them from the hallway. Jim Boren of the Fresno Bee editorial board called the Migden pick "the worst appointment of Gov. Arnold Schwarzenegger's political career."
Schwarzenegger's office, in a written statement, said the idea for the appointment was from newly sworn-in Senate President Pro Tem Darrell Steinberg.
"Senator Steinberg recommended Senator Migden to serve on the Integrated Waste Management Board because she has held several elected positions throughout local and state government for nearly 20 years and her background will serve well in this new role to promote zero waste in California in partnership with local governments, industry officials and the public," Schwarzenegger spokesman Rachel Cameron e-mailed in a statement.
Migden began her political career as a San Francisco supervisor before rising to become a state Assemblywoman and then Board of Equalization member and then state senator. There is a long tradition of legislative leaders and governors appointed ex-lawmakers and close acquaintances to the Integrated Waste Management Board.

Harvey Milk may be popular in San Francisco and West Hollywood, but he is not popular or admired by most California parents who want healthy sexual boundaries for their children and don't want the tearing down of every sexual boundary and standard like Harvey Milk did. Children belong to their parents, not to the state!
California parents don't want and children don't need "Harvey Milk Day." There's a big difference between a movie and school "exercises." People voluntarily go to a movie, perhaps even to see "Milk" starring Sean Penn.
Yet under SB 572, children CANNOT be excused and it will be MANDATORY for them to participate in pro-homosexuality, bisexuality, transsexuality "exercises" under SB 572.
For there is no explicit parental opt-out in the bill.
For this reason alone, SB 572 should be defeated.

The "yes" votes came from all 23 Democrats present and voting, with the additional "yes" vote of Republican Abel Maldonado, who is ignorantly or deceptively defending his anti-family vote. The rest of the 14 Republican senators voted "no," although not one Republican rose up to speak against it.
"SB 572 could mean homosexual-bisexual-transsexual pride parades in public schools every May 22," said Randy Thomasson, president of SaveCalifornia.com, which has been generating citizen phone calls and emails against the bill. "SB 572 pressures elementary, junior high and high schools to 'conduct suitable commemorative exercises' in support of the radical sexual agenda of Harvey Milk. Where are the boundaries? Where are the definitions? This in-your-face, anything-goes, homosexual-bisexual-transsexual indoctrination is definitely not what parents want for their children."
A statewide poll by Survey USA in early March found that a large majority of Californians oppose creating "Harvey Milk Day." When asked, "Do you think Harvey Milk's birthday should? Or should not? Be recognized statewide as a 'day of significance?'" 69 percent answered "should not" and only 19 percent answered "should." A majority of Democrats, independents, Republicans, liberals, moderates and conservatives each held that "Harvey Milk Day" should not become a statewide "day of significance," in schools or otherwise.
"Sadly, the California Legislature seems hell-bent on promoting the homosexual lifestyle as a role model for children," said Thomasson. "It's absurd -- the government school system teaches children not to smoke or use drugs, yet SB 572 would teach children as young as kindergarten that homosexuality is good and healthy and maybe even for them. That's just not true. Homosexual and bisexual behavior causes up to 82 percent of all HIV transmissions in California." SB 572 comes on the heels of school sexual indoctrination laws signed into law in 2007. When fully implemented, SB 777 and AB 394 will teach children in California government schools to support homosexuality, bisexuality, and transsexuality via instructional materials, programs and activities, and school "safety" guidelines. In addition, the California State School Board in 2008 implemented SB 71, requiring public schools that provide sex education to promote unmarried sexual activity with no restraints other than mutual consent.
"SB 572 instituting an official 'Gay Day' in public schools will further motivate parents to remove their children from the anti-family public school system," Thomasson said. Bill of the Week - SB 34-Restricting Paid Petition Gathering (CRI)
Under existing law, any person who is a voter or is qualified to register to vote in California may circulate an initiative or referendum petition. Any voter may circulate a recall petition.
This bill would create a new crime, by making it a misdemeanor for anyone to pay or receive anything of value, based on the number of signatures obtained on an initiative, referendum, or recall petition. This applies to state and local issues. If an organization violates this law, it will face a fine of up to$25,000 and/or up to a year of imprisonment. An individual who violates the law will face a fine of up to $1,000 and/or up to a year of imprisonment.
CRFI opposes this bill because it seeks to restrict the people's ability to place measures on the ballot.
Every initiative, referendum, and recall petition in California has a notice printed at the top, telling signers that they have the right to ask whether the signature gatherer is paid or a volunteer. Also, qualifying a measure for the California ballot requires hundreds of thousands of signatures. Almost every measure that qualifies with signatures needs paid signatures gatherers. Campaign workers, who want to make their voices heard in the California legislature, can be paid. CRFI maintains that voters should free to receive compensation for the hours they contribute toward making their voices heard on the California ballot.

"Instead, SB 572 is outright promotion of everything Harvey Milk believed in -- the entire gay, lesbian, bisexual, transsexual agenda pushed upon schoolchildren as young as kindergarten, without parental permission."
Despite the testimony of SaveCalifornia.com and other pro-family organizations, the Democrat-controlled committee passed SB 572, but not before Leno and a fellow homosexual activist, Assemblyman Tom Ammiano of San Francisco, a committee member, verbally lambasted pro-family opponents of the bill.
"Your ignorance, blaséness, and bold stupidity show the need for such a day of significance (honoring Harvey Milk)," said Ammiano, adding that the testimony of Thomasson and other pro-family leaders was "ludicrous."
In his closing remarks, Mark Leno chastised the "hate messages of those who spoke in this room today." Invoking Christ-like symbolism, Leno praised Harvey Milk, who, he said, "literally gave his life" so that open homosexuals like him could be elected to office.
Another Democrat member of the committee, Mike Eng of Monterey Park, supported the lesbian-gay-bisexual-transgender indoctrination bill for K-12 students, remarking, "We need to deal with tolerance very early."
In his testimony, Thomasson pointed out that SB 572 is written so broadly and without limits, that it would allow virtually anything that a school wanted to do to honor Harvey Milk every May 22, including "gay pride parades" and children dressing up and cross-dressing to positively depict the homosexual-bisexual-transsexual agenda.
Telling the committee that SB 572 "should be defeated because parents don't want it, children don't need it, and the public is solidly opposed to it," Thomasson held up a poll commissioned by San Francisco TV station KPIX. Conducted in March, the poll that found that an overwhelming majority of Californians oppose creating "Harvey Milk Day."
When asked, "Do you think Harvey Milk's birthday should? Or should not? Be recognized statewide as a 'day of significance?" 69 percent answered "should not" and only 19 percent answered "should." A majority of Democrats, independents, Republicans, liberals, moderates and conservatives each held that "Harvey Milk Day" should not become a statewide "day of significance," in schools or otherwise. Voting in favor of SB 572 in the Assembly Education Committee were six Democrats: Julia Brownley of Santa Monica, Tom Ammiano of San Francisco, Juan Arambula of Fresno, Joan Buchanan of San Ramon, Wilmer Amina Carter of Rialto, and Mike Eng of Monterey Park. Two other Democrats who supported the same bill last year, Jose Solorio of Santa Ana and Tom Torlakson of Martinez, were missing during the hearing.
Voting against SB 572 in committee was one Republican, Martin Garrick of Carlsbad, who was not in the room during the hearing on the bill. Welcoming Garrick back for the vote, SB 572 author Leno quipped he was "hoping to have Republican representatives here." Absent during the entire hearing and vote on SB 572 were the committee's two other Republicans, Brian Nestande of Palm Desert and Jeff Miller of Corona.
"Sadly, the California Legislature seems hell-bent on promoting the homosexual lifestyle as a role model for children," said Thomasson. "It's absurd -- the government school system teaches children not to smoke or use drugs, yet SB 572 would teach children as young as kindergarten that homosexuality is good and healthy and maybe even for them. That's just not true. Homosexual and bisexual behavior causes up to 82 percent of all HIV transmissions in California." Last year, the same bill (then numbered AB 2567) passed the Democrat-controlled Legislature, but was vetoed by Governor Arnold Schwarzenegger. "Governor Schwarzenegger should veto SB 572. This inappropriate bill tramples parental rights and has nothing to do with academic excellence," Thomasson said. "It's telling that SB 572 is supported by the anti-family teacher unions, which hold so much power and have so much disdain for protecting the children they claim to serve."
The Legislative Counsel's Digest for SB 572 states, "This bill would provide that the Governor proclaim May 22 of each year as Harvey Milk Day, and would designate that date as having special significance in public schools and educational institutions and would encourage those entities to conduct suitable commemorative exercises on that date."
The text of SB 572 states that "On Harvey Milk Day, exercises remembering the life of Harvey Milk and recognizing his accomplishments as well as the contributions he made to this state" should be conducted; specifically, "all public schools and educational institutions are encouraged to observe...and...conduct suitable commemorative exercises."
Under SB 572, what will children in government schools be taught and how will children's minds be "exercised?" The answer is whatever Harvey Milk believed or is said to have believed:

SB 572 comes on the heels of school sexual indoctrination laws signed into law in 2007. When fully implemented, SB 777 and AB 394 will teach children in California government schools to support homosexuality, bisexuality, and transsexuality via instructional materials, programs and activities, and school "safety" guidelines. In addition, the California State School Board in 2008 implemented SB 71, requiring public schools that provide sex education to promote unmarried sexual activity with no restraints other than mutual consent.
"SB 572 instituting an official 'Gay Day' in public schools will further motivate parents to remove their children from the anti-family public school system," Thomasson said. "We're encouraging parents to visit www.RescueYourChild.org to learn how to rescue their children while they still can. With public schools becoming sexual indoctrination centers, homeschooling and church schools are no longer parental options, they're parental imperatives."

Harvey Milk Proponents Bully Legislative Witnesses (CRI)
Yesterday afternoon the Assembly Education Committee, on a party-line vote, passed SB 572, Senator Mark Leno's bill that will declare every May 22 Harvey Milk Day in California. CRFI anticipated the bill would pass the committee, just as it did last. CRFI also has come to expect abusive treatment at the hands of the arrogant lawmakers on legislative committees. Yesterday's hearing was no exception.
CRFI's Karen England, along with two other witnesses representing pro-family groups, was ridiculed and bullied by Democrats on the Assembly Education Committee. Homosexual Assemblyman Tom Ammiano called the pro-family witnesses "stupid," "ignorant," and labeled their arguments "ludicrous." The bill's author stated that a Harvey Milk Day in schools is necessary because of the hate speech the pro-family witnesses had engaged in during the committee hearing. Even more disturbing, several of the other Democrats on the committee stated that schools-not the home-are the places to teach tolerance and acceptance of homosexuals.
"Since when is it bigoted and hateful to share one's traditional values in a public government hearing?" asked England. "No wonder good, decent people are scared to speak out; they've been bullied into silence by the intolerance of those hypocritically preaching tolerance."
"The lawmakers' behavior yesterday is the very reason we don't believe they are simply trying to stop hate, intolerance and bullying in our schools," continued England. "They engage in the very behavior they claim to want to end. They were rude, arrogant bullies."
The chairman of the committee, Assemblywoman Julia Brownley, was clearly undisturbed by the outrageous behavior of members of her committee. Instead of instructing the members to treat committee witnesses with respect, she allowed them to take 15 minutes bashing the citizens who had come to share their perspective on a controversial measure.
"The whole purpose of committee hearings is to hear from the public, not be ridiculed by arrogant legislators," explained England. "These hearings should at least pretend to be unbiased. And there is absolutely no excuse for elected leaders to berate citizens when they come to participate in the process. Committee hearings should not be a commercial for one side's cause."
CRFI anticipates SB 572 will eventually make its way to the governor's desk. Please begin calling Governor Schwarzenegger and urge him to once again veto Harvey Milk Day. His reasons for vetoing the same bill last year are still sound.

HR 17 by homosexual Assemblymen John Perez and Tom Ammiano declares June 2009 Lesbian, Gay, Bisexual and Transgender Pride Month in California. (CRI)
The resolution was passed by the Assembly on Monday, June 23, and was followed by an hour-long ceremony during which several individuals were escorted onto the Assembly floor to be recognized for their contributions to advancing homosexual rights.
HR 17 states the intent of the legislature to promote "egalitarian principles," touts "diversity" as one of California's "greatest strengths" and claims that to achieve a "just and fair society, we must teach our children to respect one another, to appreciate our differences and to recognize the common good in all of us."
The resolution goes on to state that "lesbian, gay, bisexual and transgender people have made important and lasting contributions to our great state" and claims "we still have a long way to go in eradicating the prejudice and discrimination" against LGBT people.
HR 17 "urges all residents to join in celebrating the accomplishments and contributions" of LGBT people and "encourages the people of California to work to help advance the cause of equality" for LGBT people.
While CRFI certainly agrees that California should appreciate the important contributions of its citizens, it should not do so based on one's sexual orientation. Also, in light of Proposition 8's passage last year, it is disrespectful to California voters for legislators to openly flout the beliefs and principles of so many of their constituents.
Californians should also note that the entire Assembly ceremony was paid for by taxpayers. With the state $24 billion debt, it is irresponsible to spend tax money on an elaborate ceremony to celebrate LGBT Pride Month. Teachers are being laid off, prisoners released from prison, and the legislature is pending money on ceremonies that sink us further in debt. The legislature has made its true priorities obvious. CRFI has submitted a Freedom of Information Act request to the Assembly Rules Committee, seeking the true cost to taxpayers for the ceremony and its attendant expenses.
Thankfully, Assemblyman Ted Gaines spoke out against HR 17; he was the only Republican who rose to truly represent California taxpayers. Gaines expressed dismay that the legislature was spending taxpayer dollars on a ceremony that directly contradicts the will of Californians. Shamefully, only 11 legislators had the courage to vote against the resolution; most Republican abstained from the vote.

Bill of the Week: Convicted Offenders and Ice Cream Trucks (www.capitolresource.org‚
AB 307 would make it a misdemeanor for a convicted sex offender, whose victims were under 16, to sell ice cream from an ice cream truck. This commonsense measure will protect innocent children from falling prey to criminals looking for access to potential victims and will reassure parents that when they permit their child to run to the ice cream truck, they won't be victims of a convicted sex offender.
But the bill was voted down in the Senate Public Safety Committee after the chairman, Mark Leno, stated the bill was "a solution in search of a problem."
Leno is the same legislator who, three years ago, opposed legislation that would have made possession of child pornography a felony.
Leno argued that citizens should be allowed up to 25 "items" of child pornography before being charged with a felony. "Items" could include a DVD containing thousands of pictures of graphic child abuse. In 2005, Leno appeared on Bill O'Reilly's television program and wouldn't admit that possession of child pornography should be a felony.
Fellow Democrat Sen. Roderick Wright attempted to reason with Leno during the Public Safety Committee hearing, explaining that an ice cream truck trolling neighborhood streets poses a threat when parents don't know who is driving that truck. Sen. John Benoit and Sen. Bob Huff also expressed their support for protecting innocent children from a sex offender with the perfect means and opportunity to prey on another victim. Out of seven senators on the committee, only those three voted for the bill. Senate Democrat leader Darrell Steinberg voted against the bill.
"It is shocking that Sen. Steinberg would place Mark Leno in charge of the Public Safety Committee when he refuses to protect children from sex predators," stated Karen England.
"Sen. Leno actually stated that only 1 out of 10 sex crime victims are assaulted by a stranger. Does than mean that Leno refuses to protect that 10 percent of victims, that their pain and suffering isn't as important as the other 90 percent? That is twisted, disgusting, and dangerous logic."

Gut and Amend Must End

Next Monday the legislature will reconvene after their summer recess. Californians can then look forward to a marathon session of more attacks on their pocket books and freedom. One of the bills that's working its way through the system is SB 54, by Senator Mark Leno (*Ohso Note - Leno is the notorious "Kiddie Porn King" of the legislature).
When the bill was introduced in January, it was designed to ban health insurers from charging individuals higher premiums based on their gender.
The bill made it all the way through the Senate and into the Assembly—without any amendments—until June 30th, when it became a "gut and amend" bill. For those unfamiliar with the legislative jargon, a gut and amend essentially means that a bill's content is completely removed and replaced with an entirely new subject, or the author is changed.
After its gut and amend, SB 54 went from a bill about healthcare to a bill that will require California to recognize out-of-state marriages performed prior to the passage of Proposition 8 last November 5th. It will also bestow upon out-of-state marriages that occurred after Proposition 8 the legal rights and responsibilities of marriage, while withholding the actual legal designation of "marriage." Consequently, the state will retroactively recognize all out-of-state same-sex marriages prior to last November, and now California's same-sex couples need only have their destination wedding in Iowa, and California will recognize all these marriages.
Basically, SB 54 is an end-run on Proposition 8.
The arrogance of pushing such a bill is mind-boggling, especially after Californians have twice overwhelmingly declared their intent to retain the traditional definition of marriage. How out of touch are Democrat lawmakers that they repeatedly force a radical social agenda on their unwilling constituents?
The truly subversive aspect of SB 54 is not necessarily what it does, but how its proponents are attempting to accomplish their goals. It's expected that those who oppose Proposition 8 will continue to fight against it, using every means possible. But the democratic process is designed to allow for a fair, honest, open debate of laws and policies that will impact all of us.
SB 54 made its way through the entire legislative process and then completely changed its topic with one committee hearing remaining. When does the public get to debate this bill? If proponents of same-sex marriage want to win the support of the public, shouldn't they do so in a public, honest manner? This end-run on the legislative process will only serve to create fiercer opposition (as with the judicial imposition of same-sex marriage) and cynicism about the true motives of same-sex marriage supporters.
The capitol staffers I talked to about the gut and amend rules explained that although there is a provision in legislative rules for substantial amendments, the amendments must still be germane. According to Joint Rule 9: "A substitute or amendment must relate to the same subject as the original bill, constitutional amendment, or resolution under consideration."
But the staffers also noted that rules are only effective when they are actually enforced. It has been the practice of the Democrat majority to allow gut and amend bills pretty much at any point in the legislative process. It's understandable that in some instances there may be a need to gut and amend a bill. However, such instances should be the exception to the rule and only as an emergency. SB 54 is an abuse of the rule; lawmakers and the public had debated a healthcare bill all session. Now, at the eleventh hour, the bill seeks to address one of the most controversial issues of our time. The gut and amend process is undermining the legislative process.
Undoubtedly SB 54 will pass the Assembly and gain concurrence in the Senate. The Democrat majority has taken every opportunity this year to express its disdain for the public's position on marriage. But even if Governor Schwarzenegger disagrees with Proposition 8, he should protect the legislative process and veto SB 54 if it reaches his desk. Allow a full legislative debate on this matter and take into account the millions of Californians who have twice expressed their opinion on same-sex marriage.
"Winning" this political battle by means of deception and subversion isn't really a win.

"Kiddie Porn King" Mark Leno must be outraged at "Tommy Turdpacker" Ammiano for stealing his thunder with the "Kiss My (homo-anal) Hindquarters" taunt at Der Arnold - if only because it steals his legislative headlines as a leech on the system.
The CC Times may try tro cover things up - in order to keep the 'Vanilla' (clueless suburban voters / taxpayers) ignorant of the way the radical leftist / gender feminis t/ homosex hate machine controls a legislative body truly not fit to pass gas...

It's always interesting to look behind the curtain at the state Capitol and marvel at the California Legislature's ingenuity at spending our money or avoiding accountability. It's just too bad this creative brilliance could not be applied to addressing fiscal crises or solving the state's water problems. The latest little outrage came in the scrutiny of the Legislature's 77 select committees by Chronicle staff writers Wyatt Buchanan and Matthew Yi. What they found was that 32 of these committees have paid staffers, with a combined payroll of $4.3 million.
It may not be a lot of money in the context of a state that keeps encountering deficits in the tens of billions, but it does seem to represent a bit of clever accounting. To put it in plain terms: It's a way for elected officials to pad their staffs.
For example, state Sen. Lou Correa, D-Santa Ana, has six people working for him who are paid through three select committees. Total number of hearings those committees have held this year: zero.Correa said those aides help augment his office staff in serving his Orange County constituents.

Leno has said he anticipates holding hearings next year. "I just walked into the house, I didn't create the rules," he told our reporters. Californians who are not so immersed in the culture of the Legislature might wonder why it needs 77 select committees in addition to the standing committees that are assigned to cover areas such as transportation, energy and myriad other issues. At least 19 of the 32 with paid staff have not met at all this year. If legislators want to expand their staffs - a questionable move in these lean times - they should at least do it in a straightforward way.
