How is it that nine months are required to resolve a misdemeanor battery charge? Did the defendant and her lawyer simply outlast the District Attorney through a steady stream of continuances? It would appear that Ms. Koenen prevailed in having the charge dismissed simply because she was able to afford it.
Regardless, her community needs to ask itself if they can trust Phoebe Koenen. Should a woman who would spit on a child and who's undergoing court-ordered anger management training be allowed to associate with other people's children?

We have had two Danville residents killed in the past few months. Both were homicieds and both were killed by a black male from Oakland.
One was a cop doing his job to protect the good people of Oakland.
One was a kid selling drugs. I in no way dispute that selling drugs is bad but homicide in Danville is very rare and if you simply looked at the percenatge of black males in Danville you would see why a pattern here.
They set the example. We have issues at my childs school and its usualy because some parent is over reacting and acting all "ghetto". Im sure had the parent gone to the school and went through the proper channels it would of been taken care of. Not to mention girls at this age, fight and the next day they are friends. My son's teacher encourages students to talk out their disagreements and work through it. She has a area in her classroom for them to do this at. It works! In math (a science) rate refers to percentages. Population refers to NUMBERS.

Since The Black Polulation is a minority, there could be a lower number compared to a larger population. Although in encarceration, the rate is so disproportional that it does not matter. Additionally, in spite of the serious problems of fatherless children in the Black community, there are FAR more White dead beat fathers than there are Black. There are FAR more Whites on Welfare and Section 8 in this country than Blacks. To your crime rate statistics, I gave examples earlier that these are more influenced by levels of poverty than by race. And if the murder of 4 Oakland Police officers are your source, then shouldn't this past week's murder of the 3 Police Officers in Pittsburgh, PA by a White Man also be cited? You cite the idiot Judge (who happened to be black) that sued the Dry Cleaners but do you honestly believe that Blacks file more frivolous law suits than Whites? I'm sure I can go after more statistics to prove you wrong, but I think the picture is clear.
Are there members of the Black community committing crimes? Absolutely. Are the "per 1,000" numbers of Blacks higher than Whites in nearly all of the areas mentioned higher? I would say that is a fair supposition. Do more Blacks live in poverty than Whites in this country? No, as with the other numbers, Whites exceed Blacks under the poverty line. Do a greater percentage of Blacks live under the poverty line than Whites? The percentage is FAR higher among Blacks (and other minorities).
The point of all this is that while from an internal percentage standpoint within race the numbers are indeed higher the areas you cited for Blacks than they are for Whites. That said, the raw numbers are far higher for Whites than for Blacks. What does this mean? That the percentage of your tax dollars used for welfare, for prisons, for all the social problems that tax monies are used for, are going more towards Whites in the system than Blacks. So yes, you actually are wrong.
Again you are using raw numbers to translate it to rates that do not coincide with the correct categories. I agree that this is an important case. I find it extremely offensive and disrespectful that one would spit on another person. Are you assuming the transfer girl falls under Priority C? Priority C discusses INTRAdistrict transfers for students living within SCHOOL DISTRICT boundaries. INTERdistrict transfers are for children who reside outside school district boundaries.
It is likely that the aunt had to sign an affidavit that she was the child's guardian. If found to be untruthful, the girl should have been expelled from the district at the very least. There are probably legal remedies available to the school district, but they will never use them.
As someone who moved out of the inner-city, I see the biggest problem with these situations is that the inner-city youth who move to not-so-diverse suburban school districts is that these kids bring the inner-city attitudes with them.
Standing up and accusing a teacher of racism because the student receives detention because (s)he didn't do homework may work in Oakland or Berkeley, but it just doesn't fly in the burbs. These kids do come to the burbs and act 'ghetto.' Look at Antioch. That was a former white-flight community. Now any whites who can move, do so. I used to live there, and I've seen kids hanging out of windows dropping to the ground rather than using the front door to leave their homes. And, now you know how folks get labeled with slang, derogatory names.
I'm Caucasian and was married for many years to a minority person from East Oakland. It's not really about race as much as it's about attitude. These kids must be taught to leave their entitlement and ghetto attitudes in the communities they're leaving if they want to be successful in the receiving communities. School districts are terrified of litigation, so they usually don't deal with these situations well.
Having said that, there is no excuse for any adult to spit on anyone else. Not a child nor an adult. The adult should have reported the child and asked that the district investigate the aunt for fraudulently enrolling her niece in SRVUSD.

I work at Apple in Elk Grove (Far from Inner City). The problem I have encountered with Elk Grove Unified School District is the Student Teacher Ratio is horrible. Elk Grove was not ready to accomodate all of the students that would be coming in with the housing boom of 2004. They built too many houses and NO schools to accomodate the overcrowding that was due to come with a community expansion of this sort. This has sense been remedied yet and still I have chosen to place my children in Sacramento Unified School District for my childrens sake. Their EDUCATION that is all that should matter.

The point I have been attempting to make, is that if this little girl is in fact, living with her Aunt in Danville, then NO laws are being broken. You are correct, if she is living in Sacramento and commuting to Danville and her family is using her Aunt's address as a legal address solely for the purpose of enrolling this little girl, then yes, there are laws and rules being broken. But I ask you, do you honestly believe that, rather than have this young woman live with her Aunt in Danville, that the family has made the illogical decision to have her "commute" from Sacramento? I suppose it's possible, but I'm sorry, it makes such little sense that I just don't see it being the case.

As a high school coach, I agree with you in this regard. But you also must know that part of the reason for bringing that inner-city "attitude" with them is as a defense mechanism. Inner city kids who come to suburban White high schools also suffer the impact of the "attitudes" of their new White classmates. And let's not forget that a significant percentage of White kids how are acting as wanna-be thugs. I'm not saying either is right and I wish I had an answer for it. I try to combat the problem when I see it personally, but as an off-campus coach, my ability is limited. As with dealing with all differences between people, education and understanding is the best tool to limit issues, but that, unfortunately is easier said than done.
A guardian is someone who has LEGAL authority over another person. A parent can appoint another adult as guardian, but it requires that legal papers be drawn. You just can't plant your kid with another adult and say that this individual is the child's guardian. I'll bet that this aunt has no such paperwork authorization her to be the child's LEGAL guardian. I think that there is probably more to a child 'residing' within district boundaries than someone saying so. Walnut Creek School District and Acalanes require an affadavit signed by the responsible adult. Residing means LIVING there and not staying part time to obtain entrance into a district to which the child is not entitled.
Part of the inner-city attitude is that these kids accuse everyone who displeases them of racism. I know people whose kids attend Oakland and Berkeley schools. The minute an administrator or faculty member enforces the rules or disciplines a child, the child cries racism. It happens all of the time. I used to live in Black Diamond Middle School. Even the staff say that the kids are animals (exact quote from a staff member).
Why wouldn't the suburban people be aghast at the behavior of these kids? I certainly would. Both of my spouses (current and former) are persons of color. My kids don't hang out of windows, they don't sit on the back of bus stop benches (they sit on the seat), they don't walk in in the middle of streets (especially with other children) so that vehicles cannot proceed, when my children are disciplined, my children and I don't scream racism when it doesn't exist, et. al.
I moved into a good school district to have my kids educated without that kind of influence. Many of us vote and pay parcel taxes to improve our schools. I don't take kindly to kids whose parents don't have any investment in the community cheating to get their kids in. It colors all of our children with the same brush.
If the suburban communities' children and parents are such bad people, then why are these children trying to get in? Perhaps if the parent(s) rented or purchased homes in these communities, they would be treated differently.

When I began responding to un-Realistic on this thread, I had the ultimately incorrect thought that he was willing to listen to an opposite side with an open mind and the ability to assimilate new or contrary information to what he has picked up in his lifetime. He has proven that he in incapable of doing so and is nothing more than a garden variety racist.
As a Black woman, I am confident that you have seen these types before and know full well that there is nothing you can do to change their small mindedness. They are who they are and are unable to pull their minds out of the sewers in which their thoughts wallow. They are incapable of accepting anyone who has ideas and concepts different from their own. Unless some magical event happens in their lives, they will go to their graves buried with the fear and ignorance which is the root cause of their thinking. After years of attempting to try to make even the smallest of inroads with these folks, I have come to understand that some simply can't be reached. Un-Realistic is one of those.
So, the end result is he will make his ill-thought out, racist posts and you can certainly respond. But do so with the knowledge that it will have no effect on him. A: Again, as I explained, I chose a different career path. I have never smoked, or frankly even seen Crack. I have never been arrested, let alone convicted of any law, misdemeanor or felony. I have done nothing in my life that would allow you to look me up in Megan’s Law.

A: No, actually, I have on a number of occasions, interceded when I saw a wrong being done. On one occasion, I happened to witness a young man beating up his girfriend in a parking lot. I stopped and pulled him off of her. My reward? She jumped me from behind. I stopped a pimp from beating up a young prostitute, holding him until the police arrived. On another occasion, I broke up an attempted carjacking. Fortunately, as a former college football player, I am a fairly big guy and don't get bothered very often. But, no, I don’t believe I am one of those guys who runs under a table when facing danger.

A: I must admit, I don’t know who or what tiff is, so I’m afraid I have no response for you there. As I have mentioned in other posts (not too hard to find if you would bother), I am a windowed father. I lost my wife and child in an automobile accident where the driver of the other car was under the influence. I am a head football coach at a high school here in Colorado. I have two other children from a subsequent marriage and have since divorced. I currently live with my girlfriend of a number of years and am employed as a PM in the IT industry. A: No, I don’t believe I put his life in danger by posting his work address. This is public information and if someone was actually intent upon doing harm, they would have done so. Do you seriously think otherwise? I did find it interesting that it took you some 20 or so posts, to actually ask a valid question. And no, I have no plans to remove the address. Elk Grove has become a haven for gangs and has a high crime rate. I don't see folks from Danville, San Ramon, Walnut Creek, or Lamorinda rushing to move or put their kids in the Elk Grove school district.
This child is 'living' with her aunt to attend schools in another city. One must wonder how well this child performed in her former school district.
I understand that parents will go to great lengths to get their kids into a district like SRVUSD, but the kids MUST adapt to their new environment. If you want something better for your kids, you and your kids have to work for it.
I've seen it happen before. Parents move their kids to safer, higher performing school districts and expect that the kids will do well just by attending schools in that district. Parents in the recipient schools become concerned about the new element.
This 'school choice' stuff doesn't work. It doesn't work in San Francisco. Oakland has had school choice for a couple of years, I believe, and more parents will turn to private education as a result. The few high-performing Oakland schools won't stay that way.

You know, it's because of these kind of issues (Danville moms and the redneck mentality) that make me want to RUN out of my current home of San Ramon. I was born in Oakland and raised in San Francisco. We came to San Ramon to raise my now teen kids in a "safer" environment. However, this community has more drugs than the media portrays. The kid that was shot in Danville? Definitely tragic. But not the innocent rosy cheeked, college bound kid they portrayed on TV.
In the 5 years we have been here, my kids have lost a total of 7 friends to suicide, drug overdoses, vehicle accidents, and now murder. SEVEN!
The mentality here is horrible....some parents condone their children's use of prescribed narcotics because "the doctor prescribed it". Then they can't understand why their kids have an addiction.
The local high school asks for a $300 "donation" (minimum)...then cries about lack of funding. Waaahhhh. Now we're talking about busing these kids because the parents are sick of the traffic congestion? Yea, let's add another $250 on to that tab.

Look, I agree with you for the most part. I don't know if they are claiming discrimination or really what is going on. But a civil lawsuit is a good way to find out. The reason of the law suits is not only money, but to get some kind of justice. if this avenue was not available, we could have a more violent society. for example, the father of the child in frustration could go and kill the other parent. Imagine your daughter being spit on, what is your first thought? unless you are an a..hole your first thought is not money but medieval revenge. We don't want that. by the time the lawsuit is ready for trial or settlement a year or so has gone by and cooler heads would prevail.
IMO, the mother suing the school district just reinforces the type of people they are. Absolutely, the woman who spat should be sued. No question. Why sue the school district? For a buck and nothing else.
No, the school should be held accountable for allowing that child to leave the school grounds while that irrate parent was there. They opened the door for this child to be assaulted on School Grounds.When children are dropped off at School they are left in their care. They should be held accountable for something. The OB who delivered my two older children took Medi-Cal when many (maybe most) other doctors were not accepting Medi-Cal patients. I asked why, and he told me that low-income, minority patients were the most litigious.
If it had been my child, I would have worked with the district to keep the woman away from the children. I would have worked with the Board of Education to prevent something like that from recurring if possible. I might have sued the mother who spit, but I doubt that I would have sued the district. I have four kids, so it's not like I haven't been involved with school issues before either.
I see these issues from both sides. Sometimes the issues aren't cut and dried, but sometimes they are.
Some People believe in working for a living. Other People want to sue for a living, because they think they are entitled (reparations, 40 acres and a mule stuff).
Would you say that if the victims family won a lawsuit and donated all the funds to a cause. It may be the entire principal of the situation. When this first was reported the school totally denied that the incident took place on school grounds. So what were they trying to hide, maybe the school authorities who were on campus at the time of the incident should be the ones sued.
As I said before, that is why many of these black children and other are trained to act like jerks. They are waiting for someone to snap and spat or tell them something or hit them so they can sue and GET PAID by crying racism. that is why, we should be more strict with the transfer and prosecute these parents if they broke the law. The school district cannot afford the welfare for these people.

I would add that when children transfer into another school district, they should attempt to adapt to the receiving district's culture. I'm not saying that the transferees can't be themselves, but they need to leave some of their stuff at their former district. I think that people need to keep in mind that when a student transfers, ADA may transfer with that student, but usually kids transfer into better-performing districts which oftentimes have hefty parcel taxes, which the transferee doesn't have to pay. IMO, transferrees should be a little humbled by the fact that they're benefitting from funding that they're not required to which they're not required to contribute.
I wish, wish, wish, that we knew the answers for crime and joblessness in minority communities. Latino communities have crime, too -- not just AA communities. My son career goal is to become a social worker and work with at-risk youth. I know that we need more role models and well-paying jobs in those communities, and emphasize education. You know that many of the Oakland school, mostly charter schools, are doing really well. As well as nearby affluent schools. I checked for my friend re: the newer Oakland school choice program.
I'm getting pretty confident that the girl's transfer was not on the up and up. And, the litigation issue bothers me. I don't like when others' behavior affects the rest of us.
Think that the spitting issue should be addressed. No person should be so disrespectful to another person. What does this mother think that she's teaching this child? The mother should be held up as an example of WHAT NOT TO DO. I wish we could engage in a little public humiliation. A school assembly during which this mother was exposed would probably clip her wings a little.

Any dollar spent defending the school or paying out a settlement/judgement is a dollar not available tol the school to actually teach children. I would be in favor of suing ANYONE that uses fraud to gain entry into a school they should not be in. btw, you can hire all the social workers you want but until mothers AND fathers raise their children to have a strong work ethic and moral code of conduct it will be a waste. How is it that nine months are required to resolve a misdemeanor battery charge? Did the defendant and her lawyer simply outlast the District Attorney through a steady stream of continuances? It would appear that Ms. Koenen prevailed in having the charge dismissed simply because she was able to afford it.
Regardless, her community needs to ask itself if they can trust Phoebe Koenen. Should a woman who would spit on a child and who's undergoing court-ordered anger management training be allowed to associate with other people's children?

Killing someone is in a totally different league.
We have had two Danville residents killed in the past few months. Both were homicieds and both were killed by a black male from Oakland.
One was a cop doing his job to protect the good people of Oakland.
One was a kid selling drugs. I in no way dispute that selling drugs is bad but homicide in Danville is very rare and if you simply looked at the percenatge of black males in Danville you would see why a pattern here.

They set the example. We have issues at my childs school and its usualy because some parent is over reacting and acting all "ghetto". Im sure had the parent gone to the school and went through the proper channels it would of been taken care of. Not to mention girls at this age, fight and the next day they are friends. My son's teacher encourages students to talk out their disagreements and work through it. She has a area in her classroom for them to do this at. It works! Parents set a good example for our children we are the role setters they see and learn from us.

In math (a science) rate refers to percentages. Population refers to NUMBERS.
when we talk about rate of incrceration in black males we refer to a percentage of the black population. Since The Black Polulation is a minority, there could be a lower number compared to a larger population. Although in encarceration, the rate is so disproportional that it does not matter. Most people on jail are black. you cannot say that a higher number of white people in the midwest and he south create a higher rate among white people. if you wanted in simple terms, apples with apples and oranges with oranges. To your crime rate statistics, I gave examples earlier that these are more influenced by levels of poverty than by race. And if the murder of 4 Oakland Police officers are your source, then shouldn't this past week's murder of the 3 Police Officers in Pittsburgh, PA by a White Man also be cited? You cite the idiot Judge (who happened to be black) that sued the Dry Cleaners but do you honestly believe that Blacks file more frivolous law suits than Whites? I'm sure I can go after more statistics to prove you wrong, but I think the picture is clear.
Are there members of the Black community committing crimes? Absolutely. Are the "per 1,000" numbers of Blacks higher than Whites in nearly all of the areas mentioned higher? I would say that is a fair supposition. Do more Blacks live in poverty than Whites in this country? No, as with the other numbers, Whites exceed Blacks under the poverty line. Do a greater percentage of Blacks live under the poverty line than Whites? The percentage is FAR higher among Blacks (and other minorities).
The point of all this is that while from an internal percentage standpoint within race the numbers are indeed higher the areas you cited for Blacks than they are for Whites. That said, the raw numbers are far higher for Whites than for Blacks. What does this mean? That the percentage of your tax dollars used for welfare, for prisons, for all the social problems that tax monies are used for, are going more towards Whites in the system than Blacks. So yes, you actually are wrong.

I agree that this is an important case. I find it extremely offensive and disrespectful that one would spit on another person. And to think that an "ADULT" spit on a child for any reason (I can't believe some are scrambling to come up with a reason to actually spit on someone). I am guessing she [Koenen] is not raising model citizens in her home. I just wish it was my child. I hope she is banned from returning to the school campus. Are you assuming the transfer girl falls under Priority C? Priority C discusses INTRAdistrict transfers for students living within SCHOOL DISTRICT boundaries. INTERdistrict transfers are for children who reside outside school district boundaries.
It is likely that the aunt had to sign an affidavit that she was the child's guardian. If found to be untruthful, the girl should have been expelled from the district at the very least. There are probably legal remedies available to the school district, but they will never use them.
As someone who moved out of the inner-city, I see the biggest problem with these situations is that the inner-city youth who move to not-so-diverse suburban school districts is that these kids bring the inner-city attitudes with them.
Standing up and accusing a teacher of racism because the student receives detention because (s)he didn't do homework may work in Oakland or Berkeley, but it just doesn't fly in the burbs. These kids do come to the burbs and act 'ghetto.' Look at Antioch. That was a former white-flight community. Now any whites who can move, do so. I used to live there, and I've seen kids hanging out of windows dropping to the ground rather than using the front door to leave their homes. And, now you know how folks get labeled with slang, derogatory names.
I'm Caucasian and was married for many years to a minority person from East Oakland. It's not really about race as much as it's about attitude. These kids must be taught to leave their entitlement and ghetto attitudes in the communities they're leaving if they want to be successful in the receiving communities. School districts are terrified of litigation, so they usually don't deal with these situations well.
Having said that, there is no excuse for any adult to spit on anyone else. Not a child nor an adult. The adult should have reported the child and asked that the district investigate the aunt for fraudulently enrolling her niece in SRVUSD.

I recall when this first happened the mother commented that the child was previously enrolled in school in Elk Grove, Ca which is in Sacrament County. The city of Elk Grove is far from innercity. I work at Apple in Elk Grove (Far from Inner City). The problem I have encountered with Elk Grove Unified School District is the Student Teacher Ratio is horrible. Elk Grove was not ready to accomodate all of the students that would be coming in with the housing boom of 2004. They built too many houses and NO schools to accomodate the overcrowding that was due to come with a community expansion of this sort. This has sense been remedied yet and still I have chosen to place my children in Sacramento Unified School District for my childrens sake. Their EDUCATION that is all that should matter.

The point I have been attempting to make, is that if this little girl is in fact, living with her Aunt in Danville, then NO laws are being broken. You are correct, if she is living in Sacramento and commuting to Danville and her family is using her Aunt's address as a legal address solely for the purpose of enrolling this little girl, then yes, there are laws and rules being broken. But I ask you, do you honestly believe that, rather than have this young woman live with her Aunt in Danville, that the family has made the illogical decision to have her "commute" from Sacramento? I suppose it's possible, but I'm sorry, it makes such little sense that I just don't see it being the case.

As a high school coach, I agree with you in this regard. But you also must know that part of the reason for bringing that inner-city "attitude" with them is as a defense mechanism. Inner city kids who come to suburban White high schools also suffer the impact of the "attitudes" of their new White classmates. And let's not forget that a significant percentage of White kids how are acting as wanna-be thugs. I'm not saying either is right and I wish I had an answer for it. I try to combat the problem when I see it personally, but as an off-campus coach, my ability is limited. As with dealing with all differences between people, education and understanding is the best tool to limit issues, but that, unfortunately is easier said than done.

A guardian is someone who has LEGAL authority over another person. A parent can appoint another adult as guardian, but it requires that legal papers be drawn. You just can't plant your kid with another adult and say that this individual is the child's guardian. I'll bet that this aunt has no such paperwork authorization her to be the child's LEGAL guardian. I think that there is probably more to a child 'residing' within district boundaries than someone saying so. Walnut Creek School District and Acalanes require an affadavit signed by the responsible adult. Residing means LIVING there and not staying part time to obtain entrance into a district to which the child is not entitled.
Part of the inner-city attitude is that these kids accuse everyone who displeases them of racism. I know people whose kids attend Oakland and Berkeley schools. The minute an administrator or faculty member enforces the rules or disciplines a child, the child cries racism. It happens all of the time. I used to live in Black Diamond Middle School. Even the staff say that the kids are animals (exact quote from a staff member).
Why wouldn't the suburban people be aghast at the behavior of these kids? I certainly would. Both of my spouses (current and former) are persons of color. My kids don't hang out of windows, they don't sit on the back of bus stop benches (they sit on the seat), they don't walk in in the middle of streets (especially with other children) so that vehicles cannot proceed, when my children are disciplined, my children and I don't scream racism when it doesn't exist, et. al.
I moved into a good school district to have my kids educated without that kind of influence. Many of us vote and pay parcel taxes to improve our schools. I don't take kindly to kids whose parents don't have any investment in the community cheating to get their kids in. It colors all of our children with the same brush.
If the suburban communities' children and parents are such bad people, then why are these children trying to get in? Perhaps if the parent(s) rented or purchased homes in these communities, they would be treated differently.

When I began responding to un-Realistic on this thread, I had the ultimately incorrect thought that he was willing to listen to an opposite side with an open mind and the ability to assimilate new or contrary information to what he has picked up in his lifetime. As a Black woman, I am confident that you have seen these types before and know full well that there is nothing you can do to change their small mindedness. As you are want to do, again you assume incorrectly. I received my degree in Criminal Justice with the idea of becoming an attorney. I had a career opportunity which took me in a different direction, so I choose that path rather than a career in law.

A: No, actually, I have on a number of occasions, interceded when I saw a wrong being done. On one occasion, I happened to witness a young man beating up his girfriend in a parking lot. I stopped and pulled him off of her. My reward? She jumped me from behind. I stopped a pimp from beating up a young prostitute, holding him until the police arrived. On another occasion, I broke up an attempted carjacking. Fortunately, as a former college football player, I am a fairly big guy and don't get bothered very often. But, no, I don’t believe I am one of those guys who runs under a table when facing danger.

A: I must admit, I don’t know who or what tiff is, so I’m afraid I have no response for you there. As I have mentioned in other posts (not too hard to find if you would bother), I am a windowed father. I lost my wife and child in an automobile accident where the driver of the other car was under the influence. I am a head football coach at a high school here in Colorado. I have two other children from a subsequent marriage and have since divorced. I currently live with my girlfriend of a number of years and am employed as a PM in the IT industry. Hopefully that answers your question. Frankly, I couldn’t care less about who or what you are.

A: No, I don’t believe I put his life in danger by posting his work address. This is public information and if someone was actually intent upon doing harm, they would have done so. Do you seriously think otherwise? I did find it interesting that it took you some 20 or so posts, to actually ask a valid question. And no, I have no plans to remove the address. Elk Grove has become a haven for gangs and has a high crime rate. I don't see folks from Danville, San Ramon, Walnut Creek, or Lamorinda rushing to move or put their kids in the Elk Grove school district.
This child is 'living' with her aunt to attend schools in another city. One must wonder how well this child performed in her former school district.
I understand that parents will go to great lengths to get their kids into a district like SRVUSD, but the kids MUST adapt to their new environment. If you want something better for your kids, you and your kids have to work for it.
I've seen it happen before. Parents move their kids to safer, higher performing school districts and expect that the kids will do well just by attending schools in that district. Parents in the recipient schools become concerned about the new element.
This 'school choice' stuff doesn't work. It doesn't work in San Francisco. Oakland has had school choice for a couple of years, I believe, and more parents will turn to private education as a result. The few high-performing Oakland schools won't stay that way.

You know, it's because of these kind of issues (Danville moms and the redneck mentality) that make me want to RUN out of my current home of San Ramon. I was born in Oakland and raised in San Francisco. We came to San Ramon to raise my now teen kids in a "safer" environment. However, this community has more drugs than the media portrays. The kid that was shot in Danville? Definitely tragic. But not the innocent rosy cheeked, college bound kid they portrayed on TV.
In the 5 years we have been here, my kids have lost a total of 7 friends to suicide, drug overdoses, vehicle accidents, and now murder. SEVEN!
The mentality here is horrible....some parents condone their children's use of prescribed narcotics because "the doctor prescribed it". Then they can't understand why their kids have an addiction.
The local high school asks for a $300 "donation" (minimum)...then cries about lack of funding. Waaahhhh. Now we're talking about busing these kids because the parents are sick of the traffic congestion? Yea, let's add another $250 on to that tab.
I just can't help but feel that people here are in a bubble.....yet, when I talk to people here, many of them are TRANSPLANTS!
I just don't get it. Im personally counting down the days 'til Senior year....

Look, I agree with you for the most part. I don't know if they are claiming discrimination or really what is going on. But a civil lawsuit is a good way to find out. The reason of the law suits is not only money, but to get some kind of justice. if this avenue was not available, we could have a more violent society. for example, the father of the child in frustration could go and kill the other parent. Imagine your daughter being spit on, what is your first thought? unless you are an a..hole your first thought is not money but medieval revenge. We don't want that. by the time the lawsuit is ready for trial or settlement a year or so has gone by and cooler heads would prevail.

No, the school should be held accountable for allowing that child to leave the school grounds while that irrate parent was there. They opened the door for this child to be assaulted on School Grounds.When children are dropped off at School they are left in their care. They should be held accountable for something. They never contacted authorities when the incident was reported, this is not the first time that school has been in legal disputes. Please do some research, or better yet. What if it was your child?

She's suing because she wants a few bucks -- bottom line.
The OB who delivered my two older children took Medi-Cal when many (maybe most) other doctors were not accepting Medi-Cal patients. I asked why, and he told me that low-income, minority patients were the most litigious.
If it had been my child, I would have worked with the district to keep the woman away from the children. I would have worked with the Board of Education to prevent something like that from recurring if possible. I might have sued the mother who spit, but I doubt that I would have sued the district. I have four kids, so it's not like I haven't been involved with school issues before either.
I see these issues from both sides. Sometimes the issues aren't cut and dried, but sometimes they are.

When this first was reported the school totally denied that the incident took place on school grounds. So what were they trying to hide, maybe the school authorities who were on campus at the time of the incident should be the ones sued.

I would add that when children transfer into another school district, they should attempt to adapt to the receiving district's culture. I'm not saying that the transferees can't be themselves, but they need to leave some of their stuff at their former district. I think that people need to keep in mind that when a student transfers, ADA may transfer with that student, but usually kids transfer into better-performing districts which oftentimes have hefty parcel taxes, which the transferee doesn't have to pay. IMO, transferrees should be a little humbled by the fact that they're benefitting from funding that they're not required to which they're not required to contribute.
I wish, wish, wish, that we knew the answers for crime and joblessness in minority communities. Latino communities have crime, too -- not just AA communities. My son career goal is to become a social worker and work with at-risk youth. I know that we need more role models and well-paying jobs in those communities, and emphasize education. You know that many of the Oakland school, mostly charter schools, are doing really well. As well as nearby affluent schools. I checked for my friend re: the newer Oakland school choice program.
I'm getting pretty confident that the girl's transfer was not on the up and up. And, the litigation issue bothers me. I don't like when others' behavior affects the rest of us.

Think that the spitting issue should be addressed. No person should be so disrespectful to another person. What does this mother think that she's teaching this child? The mother should be held up as an example of WHAT NOT TO DO. I wish we could engage in a little public humiliation. A school assembly during which this mother was exposed would probably clip her wings a little.

Are you suggesting Tar and feathers? Hey we don't know the facts of the case really. obvously this woman snapped. God knows what the girl did or say to her or her child, it does not Justify nothing. But, I thought we were through with the scarlet letter and shackling people so we can throw food at them.

There is no reason at all that this woman should have to publicly apologize to the child. that is connecting disciplie to the act.

I did not say anything about this specific case because I do not know the facts. I just think we can/should all agree on some basic civility. As far as suing a school just remember this. Any dollar spent defending the school or paying out a settlement/judgement is a dollar not available tol the school to actually teach children. I would be in favor of suing ANYONE that uses fraud to gain entry into a school they should not be in. btw, you can hire all the social workers you want but until mothers AND fathers raise their children to have a strong work ethic and moral code of conduct it will be a waste. Sad but true.
